This method circumvents the statutory licensing which is otherwise required by the Library of Congress copyright office. Will Direct Licensing on FAIRadio.net cause me to lose royalty payments from SoundExchange?
Absolutely not! Direct Licensing will actually increase your royalty payments from SoundExchange because your music will receive priority placement and plays during the “sweeps” weeks that track samples are selected for submission to SoundExchange. Typically, artists can expect to receive a 20 to 40 times increase in royalty income from music played on FAIRadio.net, plus a probable factored increase of total royalties from SoundExchange as a result of this program.
Is Direct Licensing mandatory to have my music considered for air play on FAIRadio.net? No, we will review and consider all music that is submitted. However, artists and labels that select the Direct Licensing option will receive much more play exposure than those who opt for statutory licensing. Direct Licensed tracks will play 10 to 20 times more often then tracks under statutory licensing. Plus, Direct Licensed
artists and labels will receive exclusive play each quarter during the sweeps weeks, which are used by SoundExchange to calculate weighting factors for royalty payments. How can I tell if Direct Licensing is helping my exposure? Each month you will receive statistical data for precise number and date of plays for each track you have licensed to our playlist. You will also receive a quarterly summary from the
“sweeps” sampling weeks which are submitted to SoundExchange. How does this work? Each artist and/or label copyright owner is required to have a signed standing agreement on file. Then the copyright owner simply selects albums and/or tracks that are covered under the agreement. Tracks can be added or deleted to the covered database at will by the owner, providing we receive at least 30 days advance notice.
How much will preferred artists receive from PIR in royalties? Direct-licensed royalty payments are determined by levels of funding obtained from corporate grants and donations. It is impossible to know the amounts in advance for each calendar year. The value of benefits received by artists in the Direct License program will far exceed the actual cash value of payments. Payments will be fairly distributed based upon the actual listener “plays’ for each track played.
